1. General, scope of application
1.1. For contracts between Hobby-Wohnwagenwerk Ing. Harald Striewski GmbH (hereinafter ‘we’ or ‘us’) and our customers for goods and services offered on our website www.shop.hobby-caravan.de (hereinafter ‘goods’), these General Terms and Conditions (hereinafter ‘T&Cs’) shall apply exclusively.
1.2. Any general terms and conditions of the customer are only valid if we have expressly agreed to them or parts thereof in writing. In particular, these T&Cs also apply to contracts with our customers if we have provided goods unconditionally despite being aware of conflicting or differing general terms and conditions of the customer. In such case, our unconditional provision of goods shall not constitute express acceptance of the customer’s general terms and conditions.
1.2. Any general terms and conditions of the customer are only valid if we have expressly agreed to them or parts thereof in writing. In particular, these T&Cs also apply to contracts with our customers if we have provided goods unconditionally despite being aware of conflicting or differing general terms and conditions of the customer. In such case, our unconditional provision of goods shall not constitute express acceptance of the customer’s general terms and conditions.
2. Conclusion of contract, right of rescission in the event of impediment preventing performance
2.1. Our offers to the customer are non-binding. They constitute non-binding invitations to the customer to make a binding offer on their part by placing an order with us.
2.2. By placing an order, the customer submits a binding offer to conclude a contract with us, which we can accept within 2 weeks of receiving it. The offer is accepted by means of us sending an order confirmation to the customer by email or providing the goods to the customer.
2.3. If we are impeded from providing the contractually owed goods to the customer due to incorrect and/or late delivery by our own suppliers, we are entitled to cancel the contract, provided that we are not responsible for the impediment preventing performance. The same applies in the case of unforeseeable disruptions to operations, such as force majeure, strikes, lockouts or unavoidable raw material shortages. In the event of such an impediment preventing performance, we will inform the customer without delay. If we wish to cancel the contract in this case, we will immediately exercise our right of rescission. Any payments that the customer has already made for the goods will be promptly refunded.
2.2. By placing an order, the customer submits a binding offer to conclude a contract with us, which we can accept within 2 weeks of receiving it. The offer is accepted by means of us sending an order confirmation to the customer by email or providing the goods to the customer.
2.3. If we are impeded from providing the contractually owed goods to the customer due to incorrect and/or late delivery by our own suppliers, we are entitled to cancel the contract, provided that we are not responsible for the impediment preventing performance. The same applies in the case of unforeseeable disruptions to operations, such as force majeure, strikes, lockouts or unavoidable raw material shortages. 3. Prices, minimum order value, payment terms, right of offset, right of retention
3.1. The prices stated in our offer on our website at the time of placing the order shall apply.
3.2. Payments are processed through PayPal. The purchase price is debited from the PayPal account specified by the customer. PayPal’s payment terms apply, as published at www.paypal.de. This also applies to payments made through PayPal using Visa or MasterCard. The shipment will be processed after receiving payment confirmation from PayPal.
3.3. The purchase price is payable immediately. No discounts are granted. Any discounts require a separate agreement with the customer.
3.4. The consequences of a payment delay or non-payment by the customer are based on the legal provisions.
3.5. The customer only has a right of offset if their counter-claims have been legally established, are undisputed or have been acknowledged by us.
3.6. The customer is only entitled to exercise a right of retention if their counter-claim is based on the same contractual relationship.

4. Delivery, transfer of risk, cost of returns in the event of cancellation
4.1. The delivery time is approximately 3 working days after conclusion of the contract. If this non-binding delivery date is exceeded by 10 days, the customer may request in writing (by fax or email) that we deliver within a reasonable timeframe; we will be considered to be in breach of our delivery obligations upon receiving this request.
4.2. Partial deliveries are acceptable as long as they are reasonable for the customer. We will bear any additional costs that arise in connection with making partial deliveries.
4.3. The shipping costs to be borne by the customer are stated when the customer places an order on our website.
4.4. The risk of accidental loss or deterioration of the goods (hereinafter ‘risk’) shall transfer to the customer at the point in time that the goods are handed over or the customer fails to accept the delivery.
4.5. If the customer, as a consumer, has purchased one or more items from us under a distance contract (Art. 312b BGB [German Civil Code]) and exercises their statutory right to cancel, they must pay the regular costs of the return shipment. This obligation to bear the costs does not apply if the delivered goods do not correspond to the items ordered.
4.2. Partial deliveries are acceptable as long as they are reasonable for the customer. We will bear any additional costs that arise in connection with making partial deliveries.
4.3. The shipping costs to be borne by the customer are stated when the customer places an order on our website.

5. Liability for costs in the case of unjustified notification of faults
5.1. If the customer reports a fault which, following an inspection by us, is found not to exist, the customer shall compensate us for any resulting damages if they were aware of the non-existence of the fault at the time of reporting it or if they were mistaken about it due to negligence. The customer has the right to provide evidence that the reported fault does actually exist contrary to the findings of our inspection. In connection with the above provisions, we are entitled in particular to claim reimbursement from the customer for any costs incurred by us, such as for inspecting the item or making any repairs requested by the customer.
6. Warranty claims
6.1. In the event of a fault, the customer’s warranty rights are based on the statutory provisions.
7. Limitation of liability
7.1. For instances of intent or gross negligence on our part or by our representatives or agents, as well as for death, injury or impairment of health culpably caused by us, we will be liable in accordance with the legal provisions. In all other cases, we shall only be liable in accordance with product liability law, for culpable breaches of essential contractual obligations, or if we have maliciously concealed a fault or provided a guarantee for the condition of the delivered goods. Essential contractual obligations are those that are necessary for fulfilling the contract’s purpose. However, compensation for culpable breaches of essential contractual obligations is limited to foreseeable damage or loss that is typical of the type of contract, except where a case other than those stated in the first or second sentences applies at the same time.
7.2. The provisions in section 7.1 apply to all claims for damages (particularly for compensation in addition to performance and compensation in lieu of performance) on any legal grounds, especially ones relating to faults, breaches of obligations under the contractual relationship, or wrongful acts. They also extend to claims for reimbursement of futile expenses.
7.3. The provisions above do not give rise to a reversal of the burden of proof to the detriment of the customer.

Für die Verschlechterung der Sache und für gezogene Nutzungen muss der Kunde Wertersatz nur leisten, soweit die Nutzungen oder die Verschlechterung auf einen Umgang mit der Sache zurückzuführen ist, der über die Prüfung der Eigenschaften und der Funktionsweise hinausgeht. Unter „Prüfung der Eigenschaften und der Funktionsweise“ versteht man das Testen und Ausprobieren der jeweiligen Ware, wie es etwa im Ladengeschäft möglich und üblich ist. Versandfähige Sachen sind auf unsere Gefahr zurückzusenden. Der Kunde hat die regelmäßigen Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht. 9. Retention of title
9.1. The goods delivered by us shall remain our property until we have received full payment for them.
10. Applicable law, place of jurisdiction
10.1. The contractual relationship with the customer is subject exclusively to the laws of the Federal Republic of Germany.
10.2. If the customer’s place of business or residence is not in the Federal Republic of Germany, the non-exclusive place of jurisdiction shall be Kiel. This does not affect any exclusive places of jurisdictions (e.g. for legal proceedings related to debt recovery).

3. Contract language
The languages available for concluding contracts through our website are German and English.
4. Technical steps leading to the conclusion of the contract
The presentation of goods on our website is for information purposes only and does not constitute a binding offer for the delivery of goods from us to customers. Rather, contracts between us and customers for the delivery of goods are concluded by means of the customer placing an order online using the forms on Hobby’s website, followed by Hobby confirming acceptance of the order. The customer can select goods on our website and add them to the shopping cart. The customer can then submit the order by clicking the button ‘Confirm order’. The order is accepted by means of Hobby sending an order confirmation to the customer by email to the customer’s specified email address or by providing the goods to the customer.
5. Correction of input errors
The customers can correct any input errors made while placing an order by using the delete and edit functions on the forms on Hobby’s website before placing their order.
6. Storage and accessibility of contract text
By clicking ‘File’ and then ‘Save as’ in their browser, the customer can save the contract text and thus the complete contract data when placing their order. The contract text can be printed by selecting the menu item ‘File’ and then the ‘Print’ function in the browser. The contract text is stored by us and can be viewed by the customer at any time upon request or sent to them by email free of charge.
7. Essential characteristics of the goods
The essential characteristics of the goods and the validity period of limited offers can be seen in the individual product descriptions on Hobby’s website. The same applies to details concerning the total price of the goods, including all associated price components and all taxes paid through Hobby, as well as shipping costs, surcharges for minimum quantities, and information relating to delivery or fulfilment and accepted payment methods. The payment due date is based on the provisions of our General Terms and Conditions.

We are not subject to any specific codes of conduct.
